CMS Vaccine Mandate

The vaccine mandate directly affects providers and suppliers that are CMS certified (primarily Part A), such as Hospitals, Home Health, Hospice, ASC, Dialysis, Skilled Nursing Facilities, HIT facilities, and Rural Health Clinics. By April 20, 2022, all of these providers must have 100 % compliance with the vaccine mandate for their employees AND THEIR CONTRACTORS.

If you, as a DMEPOS or DME Pharmacy, are contracted by or do business with any of these facilities, you fall under the same mandate. The certified entities are required to provide proof of vaccination on their contractors, so they will ask you to provide proof of vaccination for all of your employees who have direct contact with them and/or with the homes they visit (delivery/service/sales personnel). They may also require you to provide your policies on infection control and on vaccination and testing for delivery and service personnel.

It is always important to ensure that your guidelines pertaining to Covid-19 are up to date and in force:

  • Infection control/prevention policies
  • PPE use and availability
  • Emergency preparedness
  • Staff training on all of the above

Vaccine Mandate Enforcement Schedule:

March 28

CMS certified facilities and their CONTRACTORS must be 100% compliant by March 28, 2022 if the facility resides in one of the following states: California, Colorado, Connecticut, Delaware, Florida, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New Mexico, New York, North Carolina, Oregon, Pennsylvania, Rhode Island, Tennessee, Vermont, Virginia, Washington, Wisconsin.

April 14
CMS certified facilities and their CONTRACTORS must be 100% compliant by April 14, 2022 if the facility resides in one of the following states: Alabama, Alaska, Arizona, Arkansas, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Utah, West Virginia and Wyoming.

April 20
CMS certified facilities and their CONTRACTORS must be 100% compliant by April 20, 2022 if the facility resides in Texas.
